Judicial Punishment (breaches of the Legal Principle)

• The 3L Philosophy has no theory of punishment other than it must not exceed what is proportionate, consistent with the right to proportionate self-defence.
• Force in self-defense, by the victim or on behalf of the victim, is the first potential implication for the aggressor. Self-defense must be properly constituted at the moment of threat.
• Due process is afforded to an aggressor. Criminal cases are tried in a court, and punished in accordance with local community rules that do not exceed what is proportionate. Civil disputes are generally settled out of court.
• The local community may define the rules pertaining to proportionate punishment for accused aggressors found guilty by a court committed to upholding the Legal Principle.
  • Severe (criminal) violations may involve prison sentences.
  • Less severe (civil) violations may entail fines.

• A local community could form a commutation and pardon board to exercise discretion to lessen a sentence or nullify a conviction under unique but appropriate circumstances.
